Terms and Conditions

These Terms and Conditions (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and Eyooz OÜ (“Company”, “we”, “us”, or “our”), governing your access to and use of the TheSafeGrid mobile application (the “App”), the website accessible at thesafegrid.com (the “Website”), and all related services (collectively, the “Services”).

By downloading, installing, accessing, or using the App or any part of the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately cease all use of the Services and uninstall the App.

1. Description of Services

TheSafeGrid is a digital wellbeing and parental control application designed to help individuals and families manage and restrict access to specific websites, applications, and categories of online content. The App serves two primary use cases:

1.1 Parental Controls

Parents or legal guardians (“Supervisors”) may use the App to monitor and restrict the online activity of their minor children by blocking access to specified websites, applications, or content categories on a child’s smartphone or tablet (“Child Device”).

1.2 Self-Regulation

Adult users may use the App to voluntarily restrict their own access to specific applications or websites, such as social media platforms or adult content websites, on their own device (“Personal Device”).

1.3 VPN-Based Technology

To deliver its content-filtering functionality, the App employs Virtual Private Network (VPN) technology. On iOS devices, the App utilises Apple’s NEVPNManager API; on Android devices, it utilises the Android VpnService API. The VPN tunnel is used exclusively to intercept and block DNS requests or network traffic to restricted domains and applications as configured by the User. The VPN does not route your general internet traffic through any external server for the purpose of anonymisation, geo-unblocking, or any other purpose unrelated to content filtering.

2. Eligibility

2.1 Age Requirement

The Services are intended exclusively for users who are at least 18 years of age, or the age of legal majority in their applicable jurisdiction, whichever is greater. By accepting these Terms, you represent and warrant that you meet this age requirement.

2.2 Parental and Guardian Use

If you use the Services to manage a Child Device, you represent and warrant that you are the parent or legal guardian of the minor in question and that you have the legal authority to consent to the collection and processing of data from that device on the minor’s behalf.

2.3 Account Registration

You must create an account to access the full functionality of the Services. You agree to provide accurate, current, and complete information during registration and to keep your account information up to date. You are solely responsible for all activity that occurs under your account.

3. VPN Services — Disclosure and Consent

In compliance with the requirements of both the Apple App Store Review Guidelines and Google Play’s Developer Program Policies regarding the use of VPN APIs, we make the following explicit disclosures:

3.1 Purpose of the VPN

The VPN functionality within TheSafeGrid is used solely to enable content filtering and blocking on the device. It does not anonymise your internet connection, mask your IP address from websites you visit, or route your traffic through servers in other countries.

3.2 Data Not Collected via VPN

The App does not use the VPN tunnel to collect, store, log, analyse, sell, share, or otherwise disclose your personal browsing data, visited URLs, application usage data, or any other personal or sensitive information to third parties for any purpose, including advertising or analytics.

3.3 Data Encryption

All data passing through the local VPN tunnel on your device is encrypted. The App does not transmit your browsing traffic to any external server for filtering purposes; filtering is performed locally on the device.

3.4 User Consent

Before the VPN is activated on your device, the App will display a clear and prominent disclosure explaining the nature and purpose of the VPN connection. Your explicit consent (via a tap-to-accept action) is required before the VPN tunnel is established. You may revoke this consent at any time by disabling the VPN within the App or through your device’s system settings.

3.5 Prohibited Uses

You agree not to use the VPN functionality of the App for any purpose other than content filtering as described herein. In particular, you agree not to use the VPN to circumvent geo-restrictions, violate the terms of service of third-party platforms, or engage in any unlawful activity.

3.6 Compliance with Local Laws

You are responsible for ensuring that your use of the App and its VPN functionality complies with all applicable local laws and regulations in your jurisdiction. The Company makes no representation that the Services are appropriate or available for use in all locations.

4. Subscription, Pricing, and Payments

4.1 Free and Paid Tiers

The App may offer both a free tier with limited functionality and one or more paid subscription plans providing access to additional features. The specific features available under each tier are described within the App and on the Website.

4.2 In-App Purchases

Paid subscriptions and any other in-app purchases are processed through the Apple App Store or Google Play Store, as applicable. All billing is handled by the respective platform, and your purchase is subject to that platform’s payment terms and policies. The Company does not directly process or store payment card information.

4.3 Subscription Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled by you at least 24 hours before the end of the current period. You can manage and cancel your subscription through your Apple ID account settings or your Google Play account settings at any time.

4.4 Refund Policy

All purchases are final and non-refundable, except as required by applicable law or as provided by the applicable app store’s refund policy. Refund requests must be submitted directly to the Apple App Store or Google Play Store, as the Company does not control refund decisions made by these platforms.

4.5 Price Changes

We reserve the right to change subscription prices at any time. You will be notified of any price changes in advance, and your continued use of the subscription after the effective date of the change constitutes your acceptance of the new price.

5. Parental Controls and Child Privacy

5.1 Supervisor Responsibility

If you use the App as a Supervisor to manage a Child Device, you accept full responsibility for configuring the App appropriately and for ensuring that the monitoring and blocking features are used in a manner consistent with applicable laws and the best interests of the child.

5.2 COPPA Compliance

The App is not directed at children under the age of 13. We do not knowingly collect personal information directly from children under 13. If you believe that a child under 13 has provided us with personal information without parental consent, please contact us immediately at hello@thesafegrid.com so that we may delete such information.

5.3 GDPR and Children’s Data

In the European Economic Area (EEA), the processing of personal data of children under 16 (or a lower age as permitted by the applicable Member State) requires the consent of the holder of parental responsibility. By using the App to manage a Child Device, you provide such consent on behalf of the minor.

5.4 Transparency with Children

We encourage Supervisors to be transparent with their children about the use of monitoring and blocking features, in accordance with applicable laws and best practices for digital parenting.

6. Acceptable Use Policy

You agree to use the Services only for lawful purposes and in a manner that does not infringe the rights of others. You agree not to:

  • Use the Services to harass, stalk, or harm any individual.
  • Attempt to gain unauthorised access to any part of the Services, other users’ accounts, or any systems or networks connected to the Services.
  • Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the App.
  • Interfere with or disrupt the integrity or performance of the Services or the data contained therein.
  • Use the Services to transmit any malware, spyware, or other malicious code.
  • Circumvent any technical measures implemented by the Company to protect the Services.
  • Resell, sublicense, or otherwise commercially exploit the Services without the Company’s express written consent.

7. Intellectual Property

7.1 Ownership

All intellectual property rights in and to the Services, including but not limited to the App, the Website, all software, text, graphics, logos, icons, images, audio clips, and the compilation thereof, are owned by or licensed to Eyooz OÜ and are protected under Estonian, European Union, and international intellectual property laws.

7.2 Limited Licence

Subject to your compliance with these Terms, the Company grants you a limited, non-exclusive, non-transferable, revocable licence to download and use the App on devices that you own or control, solely for your personal, non-commercial use.

7.3 Restrictions

You may not copy, modify, distribute, sell, or lease any part of the Services, nor may you reverse engineer or attempt to extract the source code of the App, unless applicable laws prohibit these restrictions or you have the Company’s written permission.

8. Third-Party Services and Links

The App or Website may contain links to or integrations with third-party websites, services, or applications. These links are provided for your convenience only. The Company has no control over the content or practices of third-party services and accepts no responsibility for them. Your interactions with third-party services are governed by those parties’ own terms and privacy policies.

9. Disclaimers and Limitation of Liability

9.1 No Guarantee of Effectiveness

While TheSafeGrid employs robust VPN-based filtering technology, the Company does not guarantee that the App will block all restricted content at all times. New websites, domains, or applications may not be immediately included in blocking lists. The Company shall not be liable for any content that is accessed despite the use of the Services.

9.2 “As Is” Basis

The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

9.3 Limitation of Liability

To the fullest extent permitted by applicable law, in no event shall Eyooz OÜ, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, goodwill, or other intangible losses, resulting from: (i) your access to or use of, or inability to access or use, the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; or (iv) unauthorised access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not the Company has been informed of the possibility of such damage.

9.4 Maximum Liability

To the extent permitted by law, the Company’s total cumulative liability to you for any claims arising from or related to these Terms or the Services shall not exceed the total amount paid by you to the Company in the twelve (12) months immediately preceding the event giving rise to the claim, or EUR 100, whichever is greater.

10. Indemnification

You agree to defend, indemnify, and hold harmless Eyooz OÜ and its officers, directors, employees, and agents from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Services, including but not limited to your use of the VPN functionality in a manner not permitted by these Terms.

11. Termination

11.1 Termination by You

You may terminate your account and stop using the Services at any time by deleting the App from your device and cancelling any active subscriptions through the applicable app store.

11.2 Termination by the Company

The Company reserves the right to suspend or terminate your access to the Services at any time, with or without notice, for any reason, including but not limited to your breach of these Terms.

11.3 Effect of Termination

Upon termination, your right to use the Services will immediately cease. Sections of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 7, 9, 10, and 12

12. Governing Law and Dispute Resolution

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions. As an Estonian company operating within the European Union, Eyooz OÜ is also subject to applicable EU regulations, including the General Data Protection Regulation (GDPR).

12.2 Jurisdiction

Any legal action or proceeding arising out of or relating to these Terms or the Services shall be brought exclusively in the courts of competent jurisdiction located in Tallinn, Estonia, and you hereby consent to the personal jurisdiction of such courts.

12.3 Consumer Rights

Nothing in these Terms shall affect your statutory rights as a consumer under the laws of your country of residence, including your right to bring a claim before the courts of your country of residence or to benefit from mandatory consumer protection provisions.

12.4 EU Online Dispute Resolution

If you are a consumer located in the European Union, you may also use the European Commission’s Online Dispute Resolution (ODR) platform to resolve disputes: https://ec.europa.eu/consumers/odr

13. Changes to These Terms

The Company reserves the right to modify these Terms at any time at its sole discretion. When we make material changes, we will notify you by updating the “Last Updated” date at the top of this document and, where appropriate, by sending a notification through the App or to the email address associated with your account. Your continued use of the Services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the revised Terms, you must stop using the Services.

15. Miscellaneous

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Eyooz OÜ with respect to the Services and supersede all prior and contemporaneous understandings, agreements, representations, and warranties.

15.2 Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms shall remain in full force and effect.

15.3 Waiver

The failure of the Company to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of the Company. The Company may freely assign its rights and obligations under these Terms.

15.5 Language

These Terms are written in English. In the event of any conflict between an English version and a translated version of these Terms, the English version shall prevail.
